Terms of Sale

Please read these Terms of Sale; they are important.

If you do not agree to these Terms of Sale do not place an order.

1. Orders 

1.1 By placing an order with us you are agreeing to be bound by these Terms of Sale. You are also confirming that you are over eighteen and that you agree to our use of your personal data in accordance with our Privacy Policy.

1.2 We are DGPSUK Ltd. Our head office is at 30 Waggon Road, Ayr, KA8 8BA - Our telephone number and email address can always be found at the bottom of our website on every page.

1.3 Following our receipt of your completed electronic order and payment, we will contact you by email to confirm the details of your order and supply you with an order reference number which should be used in any contact with us. If we cannot, for any reason, accept and process your order, we will notify you accordingly.

1.4 We reserve the right to reject any order, as we see fit, without giving any reason (although we do try to give a reason when possible).

1.5 We may change these Terms of Sale at any time by posting changes on this website, and without giving you notice, so please check these Terms of Sale whenever you complete an order form and before you submit it to us.  If you place an order with us after we have posted any change to these Terms of Sale, you will be agreeing to that change.

1.6 Please note that our Terms and Conditions of Use or our Privacy Policy may change at any time, so please check them each time you visit this website.

1.7 Right to cancel:  If you are a consumer, i.e., if you are an individual and are placing an order for purposes outside your business, within the European Union, you may cancel your order before the expiry of fourteen working days beginning on the day after you receive the goods from us. If you wish to cancel, please send an email, telephone us or login to your account and start a return, please included the reference number if cancelling via phone or email.

1.8 Once your order has been dispatched you must inform us within 30 days if you have not received your purchase. We may be unable to resolve issues after 30 days and the customer may not be entitled to any refund.

1.9.1 INTERNATIONAL ORDERS:  All International sales are at the risk of the buyer. Once the package is confirmed to have arrived in your country it is deemed by us as delivered. Limited assistance will be provided for tracking. All import fees are the responsibility of the customer, we do not accept any responsibility for fees imposed by your country. Do not purchase if you do not accept this condition as we are not liable for any losses out with the United Kingdom and refunds will not be given if the parcel is lost within the receiving country.

1.9.2 PRE-ORDERS: By ordering products marked as (PRE-ORDER) you are accepting that you will wait between 4-8 weeks for these items. Depending on other items ordered at the same time that are in stock you may also wait for these items to be delivered at the same time as the pre-ordered items.

1.9.3 PRE-ORDER CANCELLATIONS: If you order an item on pre-order and cancel it before fulfilment there is a 5% cancellation fee. This is due to the fees we incur from the manufacturer/supplier.

2. Deliveries

2.1 Please refer to our estimated delivery times. We cannot guarantee delivery within any time frame, however if we fail to deliver your items due to an issue within our control or the couriers control within thirty days after we have accepted your order, or have made a number of reasonable attempts to do so, you have the legal right to cancel your order for a full refund. 

2.2 We reserve the right to add an additional fee and an extra 2 to 5 working days for deliveries to the Scottish Highlands & Islands, Channel Islands, N.Ireland, Isles of Man & Scilly.  Charges may also apply to the following, but not exclusive list, of postcodes: IV, HS, KA27-KA28, KW, PA20-PA49, PA60-PA78, PH17-PH26, PH30-PH44, PH49-PH50, ZE, BT, IM and TR21-TR25). 2.3 Customers agree to check their goods are in prefect condition before accepting delivery/collection, we accept in some circumstances this may not be possible and as such we offer a 7 day checking period where you can let us know of any issues with delivery and we will attempt to resolve these. After the 7 day period we cannot accept any liability for delivery issues such as missing items or damage due to delivery. This does not affect our right to return policy or your statutory rights.

2.4 Any special delivery instructions requested by the Customer, for example ‘If not in, parcel can be left in porch; behind blue bin; in garage, etc…’ please be aware that parcels left unattended, or unsigned for, at the customer’s request, will be at the customer’s own risk and any parcel that is found to be missing or damaged due to the customers instruction, we will bear no liability for such loss or damage and a refund will not be issued.

2.5 When ordering via any of our delivery options, the customer agrees to help resolve any issues, and if we replace lost items, you are legally bound to both; return the original item(s) if delivered unless otherwise stated, or sign the 'lost mail request form' sent to you by the Courier.

2.6 We may deliver part of your order and charge for all items ordered, the remainder of the order will be dispatched in due course and any additional postage costs paid by us. However, any additional postage will be at the customer's cost if the customer themselves have requested alterations to the order, e.g. additional products added or any other alterations to the order which may result in different shipping costs & dates.

2.7 If the customer changes the delivery address via the courier it is at the customers risk and the customer relinquishes the right to claim if the order is not delivered.

2.8 It is strictly the customer's responsibility to provide accurate delivery address details on the order form when placing an order.  If the customer provides incorrect delivery address details, e.g wrong house number, wrong postcode, wrong business unit number, etc..., and subsequently the customer claims the parcel has not been delivered, then our business will bear no liability for such loss and no refund will be issued.

2.9 If the courier has made every attempt to deliver the parcel to your address, or if there is an issue with them getting to your location and the parcel is returned to us without the customer making every attempt to contact and work with the courier to collect or receive the parcel, or the customer refuses the delivery with no valid reason, then we have the right to add additional fees to the order and you may only be refunded for the items and forfeit the postage costs due to this being out of our or the couriers control.

3. Returns

3.1 If you exercise your right to cancel under Condition 1.7 above, you must return any items that have already been delivered to you within twenty eight days after you receive your order, we will then refund the item(s) price to you, excluding postage. However, if you return any item and it is not in saleable condition, or it has been removed from its factory sealed packaging (where applicable), and/or used, we are not obliged to make any refund. All items require to be returned in full. If on inspection of returned goods, it is found that parts are missing from individual items, no refund will be issued and, if requested, the partially returned goods will be returned to the customer at the customers expense.

3.2 If you return any item to us within twenty eight days after it was delivered to you because it is defective or because we sent it to you in error, we will refund the price of that item, and any delivery and handling charges for that item, as well as the reasonable costs of returning it to us. After these twenty eight days it is not required by law for us to accept the defective item however we will do our best to assist you in your enquiry and may offer a resolution if deemed correct by management.

3.3 If, for any other reason, you are unhappy with any item you have purchased from this website and you return it to us in a saleable condition and/or you return it to us unopened from its factory sealed packaging within twenty eight days after it was delivered to you, we will refund the price of that item, excluding standard delivery and handling charges. Whenever you return an item to us we will inspect it to check whether it is defective and if deemed in working condition, only the item price will be refunded.

3.4 If returning goods you should inform us either by email or telephone within 14 days of receiving the item that you intend to do so. When returning items you must include the original, or copy, of the invoice or packing slip, and a brief written explanation of the reason for the return. Returns should be sent using a tracked postage service and posted to : WEST COAST HARDWARE RETURNS, DGPSUK Ltd, 30 Waggon Road, Ayr, KA8 8BA. (We are not responsible for any returned items lost or damaged in transit and no refunds will be issued under these circumstances).

3.5 Any special order or customised products purchased, whether from ourselves, or sent direct from our suppliers to the customer, are non-refundable. Any products damaged by customers are also non-refundable. This is in accordance with UK and Scottish Law.

3.6 Depending on the circumstances of the return, it can take up to 14 working days from receiving the order back with us to completing the returns process (including refund). We always try to complete this as soon as possible.

4. Security

4.1 We use PayPal and Square to receive payment over the internet because we believe it they are the most secure systems available. PayPal and Square uses the industry standard, Secure Socket Layer (SSL) encryption, to ensure our online ordering facility is secure for credit and debit card transactions. Your credit or debit card details will never be transmitted to us for security and piece of mind. We will never hold your card details so we can never mis-place them. ONLY if you are using a secure connection (SSL) aware browser is the transaction fully compliant.

4.2 You will not disclose your password to anyone; you are responsible for all orders placed using it.  If you know or suspect that someone else knows your password, you will let us know immediately by contacting us.  We may suspend or change any password if there is a breach of security or misuse of this website, or if we suspect that this is the case.

5. Availability and Payment

5.1 Our prices, delivery charges and the availability of our stock are published on this website and are kept up to date to the best of our ability. The price and delivery charges payable are those in force at the date and time you send your order form to us. We may change our prices and charges at any time.

5.2 We try to ensure that the prices and charges and availability published on this website are accurate, but we need to check the prices and charges on your order form.  We will inform you if our actual prices and charges are different from those stated on your order form and the availability of the items you have ordered. If our actual prices or charges are higher than those on your order form, you may cancel your order; if our actual prices and charges are lower, we will charge you the lower amount.  We will inform you by email if any item you have ordered is unavailable.

5.3 If you order online you can pay by PayPal, credit or debit card at the time you send us your order.  We accept payment by Visa, Visa Electron, Visa Delta, Switch, Solo, Maestro and Mastercard.

5.4 You undertake and warrant that all details you provide to us when you place your order will be correct, that any credit or debit card you use belongs to you, and that there are sufficient funds or credit facilities to cover the price of the items you order and our delivery charges.

5.5 We reserve the right to obtain validation of any credit or debit card details before or after accepting any order.

5.6 Our prices and charges are inclusive of any applicable Value Added Tax and all similar taxes or duties.  If your order is to be delivered to an address outside the United Kingdom you may have to pay import duties and taxes. We are not liable for any import charges you incur and you accept these charges as part of your order. Please contact your local customs authorities for details.

5.7 Trade Accounts: All discounted orders over £1000 are required to be paid via bank transfer. There is a 35% restocking charge on all trade orders and trade orders are only dispatched after payment is made.

6. Accuracy of Information, Warranties and Disclaimer

6.1 We try to ensure that any information and material on this website that has not been supplied by a third party is accurate, but we make no representation and give no warranty that any information or material is accurate, up to date or complete.  We accept no liability for any loss or damage caused by inaccurate information or material.

6.2 If you find any inaccurate, out of date or incomplete information or material on this website, or if you suspect that something is an infringement of intellectual property rights, you must let us know immediately.

6.3 If you open, modify or remove parts from products this will directly invalidate the warranty of the product. We therefore cannot accept returns for these products unless the modification is stated within the instructions or approved by our experts.

6.4 All recommendations, guidance and advise given by our staff or representatives are their opinion based on their own experience and must be taken by the customer at their own risk.

6.5 We do not manufacture our own products, all products are checked for quality and safety before they leave our warehouse, once received you assume full responsibility of the condition, handling and fitting of the product.

6.6 We do not accept liability for any damages caused by incorrect handling and fitting.

7. General

7.1 No delay, neglect or forbearance on our part in enforcing any provision of these Terms of Sale will be, or be deemed to be, a waiver or in any way prejudice any of our rights.

7.2 If any provision of these Terms of Sale are (for any reason), held to be unenforceable, illegal or invalid in some other way, the unenforceable, illegal or invalid provision will not affect the remainder of these Terms of Sale and they will continue in full force and effect.

7.3 These Terms of Sale are governed by UK and Scottish Law and you agree to submit to the non-exclusive jurisdiction of the courts of Scotland.  The place of performance will be Scotland.

7.4 No addition to, or modification of, any provision of these Terms of Sale will be binding on us unless made in writing and signed by our duly authorised representatives. ('Writing' includes email).

7.5 These Terms of Sale together with our Privacy Policy, Terms and Conditions and your order details contain the entire agreement and understanding relating to the subject matter of your order. They supersede any earlier agreements, understandings or arrangements (whether oral and written) relating to that subject matter, but they do not supersede our Terms and Conditions of Use. You acknowledge that you are not placing your order on the basis of any statement, representation, warranty or other provision except those expressly contained or referred to in these Terms of Sale. Nothing in these terms limits or excludes our liability.

7.6 Nothing in these Terms of Sale affects your statutory rights as a consumer.

8.1 We want to protect the privacy of visitors to our website and that of our customers.  Please read our Privacy Policy and Terms & Conditions; both pages will help you to understand how we use your personal data.  We may change our Privacy Policy and Terms & Conditions at any time without notice, so please check it each time you visit this website.

8.2 Whenever you give us personal data, you are consenting to its collection and use in accordance with our Privacy Policy.
